The Principal P's of a Paralegal Career

Being a paralegal, or legal assistant, is a fulfilling and challenging career. It can be rewarding. It can also be quite stressful. The four Ps will pave the way for a successful paralegal career. These are:

1. Punctuality. Ever notice how your stress level rises when youre late for work or a meeting? You sit in traffic and the clock is ticking out a drumbeat in your head. By the time you get to work, youre flustered and certainly not in the best mind frame to calmly begin your work tasks. Instead of this nerve-racking scenario, the practical, punctual paralegal plans on leaving for work 15 minutes earlier. This allows extra time for unforeseen circumstances to intrude but not alter ones sense of serenity. I have a rule of thumb anticipate five irritations while driving to work and smile through them. If theres more than five, well, maybe its time to pull off the road and let the maniacs go on ahead.

2. Patience. Be gentle with yourself. If you feel tenseness building, take deep, cleansing breaths, and several more as needed. Oxygen fills your lungs, your pulse lowers, and a feeling of peacefulness returns. Paralegals practice patience toward co-workers, clients, phone callers, anyone who may not quite have being gentle with themselves mastered yet.

3. Perseverance. A missing witness? Keep trying to locate him, and stop when you do. A file has disappeared? Search until its found and ask others for assistance. Feeling brain-dead while summarizing a very dry deposition transcript? Get up and stretch, look out a window for a few minutes while you feel yourself relaxing. Then don your determination again, and get back to the grind. Legal assistants who excel in their jobs are dedicated to completing tasks.

4. Pride. If you know youre doing your best, you will feel proud of your accomplishments. Ensure your work product reflects positively on you and your boss. Every document going out of your office gauges quality; for professionals this is extremely important. Sloppy work does not go unnoticed. Check and then doublecheck your documents. Are they as clean and attractively presented as possible? If so, sit back and smile.

The above principal Ps for paralegals are, of course, only part of what highlight good skills. But they are very important. They also contribute to attaining satisfaction and pleasure in ones position. Being good at your job AND enjoying it, what a great combination!

The Secret to Athletic Success

Why is it that one day we can hit every ball right down the middle, or pick up every frame and the next day, or game, we can hardly keep it on the fairway or in the lane? What causes athletic inconsistency? What is the secret to athletic success?

When you talk to professional athletes they speak of being in the zone when performing at a high level. If you talk to a running back hell explain how everyone seemed to move in slow motion and that the hole seemed wide enough to drive a truck through. A tennis player might tell us she could see the spin of the ball and could anticipate exactly where her opponent was going to hit it. A bowler might say he was in the groove. What is this zone that these athletes describe and how do we get into it?

Before we talk about getting into this zone lets talk about the realities of athletics. Most likely you are not a professional athlete. You are probably a regular person that has lots of interests besides bowling, basketball or whatever your chosen sport(s) happen to be. So if you arent a professional athlete, spending hundreds of hours a year at your profession, you probably arent going to hit scratch golf every time you go out or become a karate champion, but you may become your club champion and you may win a local tournament or two. In other words you can become the best athlete possible depending on the time you choose to invest in your sport. So get over trying to be a pro, unless you have the time to invest to play at that level, and decide to develop your abilities to the level where you both play your best, and enjoy every moment you play.

The 5 Steps to Athletic Success

1. Get a Coach Few people who participate in athletic activities actually get instruction. For example the number of people who actually get lessons from a pro golfer over their lifetimes is about eleven percent. The number of people that get training from a personal trainer at a gym is about the same. What is the percentage of people that actually take tennis lessons? You might have guessed, its about the same.

It would be nice if all we had to do is watch someone else and be able to play a sport well, but for most of us this is just not a reality. Even the pros have coaches. Golfing sensation Tiger Woods has Hank Haney. Steffi Graf had her father Peter. Even the greatest boxer of all time, Muhammad Ali, had Angelo Dundee. All the greats have coaches and so should you.

In order to play any sport well you need to learn the basics; how to maximize your exercises, place your body, kick your leg, roll the ball, etc. Coaches can shortcut the time it takes to become proficient at any sport while reducing your chance of injury due to incorrect form. Get a coach.

2. Practice How did you learn to walk? You practiced. After you crawled around for a while you decided to walk and hang on to the furniture. Then you stumbled around, bumping your head and bottom until you could walk. If you would have laid in your crib and only watched people walk you would have never learned how.

The same goes for playing a sport. You cannot sit watching Tiger Woods on TV, never going to the driving range and expect to be able to play on the pro circuit. You wont be able to watch old Bruce Lee movies and become a black belt. And you wont be able to become a marathon runner by walking a mile every few days. For any sport you need to learn the rules, practice the basic techniques of the game and develop your body to be able to play the sport comfortably.

3. Set a Goal - Human beings are goal seeking mechanisms. In order to achieve you need to be able to have something to reach for, something tangible. If you want to improve your golf game you need to set a tangible goal of decreasing your score to 80. If you want to bowl better you need to set a goal to increase your score to an average of 180. If you want to be invited to body building contests you need to set a goal of less than 10 percent body fat. Now these may not be your goals but they are real goals, goals that you can shoot for and achieve. You see the one thing that all achievers do is set goals. We become better when we have a goal to focus on.

4. Get Feedback We all need feedback. One place well get good feedback is from our coach. As we already talked about, feedback from someone who has dedicated their life to helping others improve in their chosen sport is well worth the expense. We can also get feedback from others in the sport that are just a little further along the path than we are. In fact, this can sometimes be priceless because they are acutely aware of what we are going through as a result of having recently going through what you are currently going through. So find a coach and find some people that are just a little bit better than you and ask for their advice. Not only will they be happy to give it, you will learn some great shortcuts toward mastering your sport.

5. Learn the Mental Game In 1989 when questioned about tennis greats, Chris Evert told Sports Illustrated, "With me, the mental part of the game was always stronger than the physical. Martina was always known for the physical aspects of her game. Steffi has both."

Chris Evert knew that the mental game was paramount. So do all top athletes. So how do you improve the mental game? First you need to overcome negative programming. Get over what you cant do. Like Henry Ford said once, If you think you can you can and if you think you cant you cant. Although we have learned to do a number of very complex things in our lives, from walking, to writing, from speaking to eating with a knife, fork and spoon, we often feel that we cant play a sport well. We say to ourselves, Im just not good enough. Just because you werent able to hit a shot a few weeks ago doesnt mean you cant hit that shot today. Or just because you could only kick waist high a month ago doesnt mean you cant kick chest high today. Instead of focusing on what we cant do we need to focus on incremental improvement.

Physical improvement, like anything else, is a step by step process. When you keep at it and focus on where you want to be, little by little, your mind and body will take you there. Keep in mind that the level of your game is in direct proportion to the amount of time you can invest in it. In other words, dont program yourself to think youre not good at a sport because you dont play at the same level as your sports idol. Your sports idol became good through practice and so will you. Leave the comparisons for how much improvement you are making, not to how much better (or worse) someone is than you.

Two Mental Factors

Athletic success requires two critical mental factors. The first is physical relaxation. The second is mental concentration or focus. Mastering these two will skyrocket your performance.

Take a look at this typical example. The first guy in your group tees off and hits it 250 yards. You watch it fly perfectly and fall right in the middle, a chip shot to the green. Now its your turn and what do you do? You think to yourself Wow he really hit that one! and your hands get tight, your arms get tight and you hit the ball with all your might, and it dribbles off the tee. Why did that happen? You made two giant mental mistakes. You tightened up instead of relaxing and you focused on what the other guy did rather than your own game.

So how can you correct these mistakes? How can you learn physical relaxation and mental concentration? You need to do what the professionals do - you need to program yourself for success.

After you learn the basics of the game all the movements you make in sports are done at a subconscious level. This is true for everything we do in life. For example, when you drive you dont think about it, you just drive. When you started driving it wasnt this way at all. You had to think about everything at a conscious level. You had to adjust the mirrors, decide how to push the gas pedal and if you had a clutch, wow, that was a real challenge. But little by little you became better and better and now you drive subconsciously. You can be driving down the road with a cup of coffee in one hand while talking to your friend in the passengers seat and if a car pulls out in front of you your foot goes to hit the breaks automatically. Thats a subconscious stimulus response reaction. You could actually be riding in your friends car in the passenger seat when a car pulls out in front of you and what will happen? Your foot hits the carpet with the same stimulus response reaction even though you know consciously that it wont stop the car.

In order to become good at a sport you need to teach your body the correct stimulus response reaction for each key area of your game. That way you can relax and let your body do the work it needs to do to make you successful. Thats the reason for practice, to make the bodys performance automatic. But in order to have useful automatic performance the practice must be with correct form and thats why a coach is so important.

Automatic performance can be aided by hypnosis to help you see, or visualize yourself performing correctly. In order to do this you need to remember a time when you performed extremely well, a time when you felt in the zone or at least near to it. Then, using all of your senses you need to be able to describe how your mind feels, what you see, what you hear, how your body feels. This may appear as confident, strong, relaxed, focused, perfect concentration or even smooth, depending on your sport.

Once you have discovered the place where you perform at your best you can then use hypnosis to learn how to relax and bring it up automatically. Heres how. Put yourself in a relaxed state. Then visualize the time when you performed extremely well. Use an anchor, such as making an O with your thumb and forefinger or pressing the inside of your elbow with your forefinger and give yourself an audio trigger such as saying yes. Repeat this process several times. The next time you practice physically or compete, use this combination of a physical anchor and an audio trigger to put yourself in the zone. You may be amazed at your level of performance.

NAFTA and the Management Consultant Dilemma

It is a common scene, repeated over and again at the various U.S.-Canada border posts. A young Canadian executive approaches an officer of the United States Department of Homeland Security, and hands her a small pile of documents prepared for him by the HR Manager of his prospective employer.

"I'm here to apply for a TN visa," declares the applicant.

"In what category?"

"Uh... Management Consultant."

The immigration officer glances at the documents with an air of distaste and tells the applicant to take a seat. Thirty minutes later the officer calls the applicant into an office and subjects him to a grueling hour of cross-examination.

"What is this?" demands the officer, shoving a piece of letterhead in his face. The applicant peers at the document. "It's a letter from the company that wants to hire me."

"It's too short and doesn't describe a management problem," says the officer, tossing aside the letter and pulling out another document. "How about this?"

"That's my resume," answers the applicant, his face turning red.

"Uh, huh..." says the officer. "Just what are you trying to pull here?"

"What do you mean?" asks the applicant.

"You're no Management Consultant. You don't have any management experience."

And so on...

The result: Denial of the TN application. The reason: Either the position or the applicant do not qualify for the Management Consultant designation. The consequences: Lost time, lost money, loss of a potentially valuable employee, loss of a lucrative job opportunity, and humiliation.

The Management Consultant Category - An Incorrectly Perceived Loophole As most people involved in HR Management are aware, the North American Free Trade Agreement (NAFTA) has simplified the placement of certain Canadian professionals into high-demand jobs in the United States. As long as the candidate fits into the cookie-cutter professional categories listed in Appendix 1603.D.1 of the NAFTA, the interested company is able to avoid the longer processing times and higher fees associated with the H-1B visa.

Most of the NAFTA categories require at least a bachelor's degree. And as long as the candidate can prove he or she has the required education, approval of a TN visa is virtually assured. For example, a Canadian Engineer with a bachelor's degree should have no trouble qualifying for a position as an Engineer with a U.S. company.

A few NAFTA categories, however, allow for the substitution of work experience in place of a bachelor's degree. One of these is the Management Consultant category, which allows "five years of experience as a management consultant, or five years experience in a field of specialty related to the consulting agreement" to substitute for a missing bachelor's degree.

Unfortunately, the Management Consultant category is incorrectly perceived by many HR Managers as a sort of "loophole" in the immigration law which allows them to place well-qualified candidates who have not completed a formal degree program, but who are otherwise qualified for the position offered because of their experience in the subject field.

Thus, HR Managers frequently send non-degreed persons such as computer professionals with no management experience to the border, allegedly to accept a job in the States as a "Management Consultant"; or they send non-degreed candidates with management experience to the border, with the intent of placing them in long-term management positions with U.S. companies. Applications such as these are invariably doomed to failure.

Why the Management Consultant Designation is So Difficult to Obtain
USCIS Free Trade Officers are well aware of the misperceptions that exist regarding the Management Consultant category. They adjudicate and deny countless bogus TN applications in this category on a daily basis. So whenever someone presents at a U.S.-Canada border with a TN application seeking admission through the Management Consultant category, the officer's guard immediately goes up.

While it is difficult for the officer to deny a TN visa when the applicant has a university degree, it is fairly easy to question whether a non-degreed applicant's experience is "relevant" to the Management Consultant position offered. It is important to realize that U.S. immigration law gives its Free Trade Officers complete and unfettered discretion to make a decision on a NAFTA visa application. Denials are not appealable. So, when they have an opportunity to use this discretion, they do so...with a vengeance.

Make no mistake: the Free Trade Officer will go through every word of a TN application, compare the applicant's CV with her employment-based reference letters to look for contradictions and analyze the company's cover letter and its financial statements. Finally, the officer will thoroughly grill the applicant with respect to her alleged prior experience and her proposed duties with the new company. Most applications in the Management Consultant category do not hold up under this type of scrutiny.

So, What Exactly is a Management Consultant Anyway?
Contrary to the belief of most HR Managers, a "Management Consultant' (for purposes of U.S. immigration law) is not a manager. A "Management Consultant" is a consultant to management hired by an organization to help solve a particular short-term management problem. Free Trade Officers view these consultants as "hired guns": they are hired to solve a particular problem, and then they must get out. Offers of company benefits such as retirement and 401K plans, stock options, and life insurance are inconsistent with this view. These types of benefits are all trappings of a permanent employee, not a short-term temporary employee.

Therefore, at minimum, the company's cover letter to the INS should state with particularity the management problem to be solved, the reason for the short-term need for an outside consultant, how the applicant is qualified to solve the problem, and the terms of compensation. The application should also include a detailed CV which documents at least five full years of relevant experience, as well as detailed reference letters from all past employers consistent with the CV. Contradictions between any of the above documents will be duly noted by the Free Trade Officer, and will likely result in the denial of a TN visa.

The Effect of Past Denials
All is not lost if a TN visa is denied by a Free Trade Officer. That same complete and unfettered discretion wielded by one Free Trade Officer empowers the next officer to re-consider an application as if presented for the first time, if the officer wishes to do so. Because of this, it is entirely possible for an applicant to be refused by one officer at Niagara Falls in the morning and admitted by another officer at Pearson International Airport in the afternoon, without any change to the application However, our firm does not recommend the latter approach, because some officers will perceive the same-day reapplication as an attempt to play the system.

Our firm has successfully assisted a myriad of individuals who have been refused once, twice or even three times. (Of course, the more times one has been refused, the more difficult the case becomes.) Our task as experienced immigration lawyers is the same in all of these cases: a.) Complete evaluation of the Applicant and the Proposed Employment; b.) Selection of the Proper Visa Category; and c.) Assembly of the most USCIS-Friendly Visa Application Possible.

Some Recommendations
It is always better for all parties concerned if, instead of trying to handle important immigration matters on their own, HR Managers and potential TN applicants take the time to consult with an immigration professional prior to applying for a visa. The savings in time, money and frustration are well worth the investment. However, if they insist on handling these delicate cases on their own, it is helpful to keep the following in mind:

1. A Management Consultant is a hired gun-a consultant to management hired to solve a short-term management problem;
2. A Management Consultant should not be compensated over and above the base salary;
3. A non-degreed applicant must have a minimum of five complete years of verifiable experience as a consultant to management or in a field of specialty related to the consulting agreement. Make sure you have the documents to prove all five years;
4. There should be no discrepancies whatsoever between any of the documents presented to the Free Trade Officer;
5. The applicant should be prepared to answer intelligently, and in detail, the officer's questions regarding: a.) the applicant's past experience, and b.) the management problem he or she is being hired to solve;

How Internet Marketing And Sports Made Me A Success

Man, I could visualize myself doing the same thing. I thought to myself "If only I could do that"! Later that year I decided to become a softball player.

Unfortunately it was alot harder than it looked. I joined a team that was near the bottom of the rankings, no one else wanted me. Why? Because I was a downright bad player. And I mean badly as in no good.

In fact I stunk! The only thing I had going for me was this fierce burning desire to succeed as a good softball player. The fire was inside me and I wanted to be "GOOD!" Now what does this have to do with Internet Marketing?

Just give me some time here and you will see where this is going. At 22 years of age I could not run, throw or hit. Nor did I have any special athletic abilities, at 5'7" and about 130lbs. I was not much of a softball player.

The team I joined used me very sparingly and rightly so. My butt was on the bench so often I was seriously considering buying pillows for my rear end.

The following year before the new softball season started. I purchased a book called "How to play slo-pitch-softball". This book was instrumental in my education and desire to become a good softball player. It had techniques on holding the bat, fielding, throwing, and running the bases. I read it thoroughly and followed its advice. That season I became a better player. I Spent much less time on the bench.

The next year I decided to become even better. I purchased a book called "Hitting a softball for distance and power" It thought me what exercises I needed for upper body strength, what type of bat to use for quicker more powerful swings. Clearly the following year I no longer sat the bench. I also purchased a book called "Leg exercises for speed". It took a few years but I became faster, quicker and stronger.

I was now in my late twenties and at 160lbs. a very good slo-pitch softball player. I had numerous teams asking me to play for them. Wow what a turnaround! It took me about 6-8 years to become a successful softball player. Now again you say what the heck does this have to do with Internet Affiliate Marketing?

Actually plenty. I am now in my mid fifties. At first I stunk at Internet Marketing just like I did at softball but I slowly began to get better. I read till my eyes burned and I still do. I am making an extra income.

Just like soft ball I had this Burning desire to succeed. I had to read and follow the techniques in books, ebooks, and numerous pdf downloads on what I needed to become a successful "Internet Marketer". I studied learned and became familiar with HTML, CSS, PHP, and many other programs. I also joined forums, blogs, and article writing websites that would help me in my quest to become successful.

Just like softball I had to stay away from bad neighborhoods. If you've done any kind of marketing at all you know the horror of getting bad or wrong information.

Sell and Rent Back Property on the Rise

Many owners are looking to the new trend of sell and rent back property to save them from foreclosure. The last decade has been a recorded breaking period for interest rates. Borrowers have extended credit well beyond anything that the industry has seen before. Lenders have only aided in the situation.

Now interest rates are on the rise.

Borrowers who took advantage of incredibly low variable rates (ARM) and extended their payments to the edge of their means are now beginning to feel the crunch. Some are learning that the new payments are beyond their income limits. In response, many are looking to lock in an interest rate. For most, it is already too late.

With payments too high to manage, borrowers are struggling to find an answer. Some are looking to the sell and rent back property industry that is springing up. These companies offer exasperated consumers the option of selling their home (below market value) quickly sometimes as quick as one week without any closing fees or other cost associated with selling a home.

After the sell, the consumer can rent the property at a payment that is often less than the mortgage payment. It seems like the miracle answer for many borrowers. For most, this should be the last resort.

Before a home owner turns to the method of sell and rent back property, they should consider all other possible means.

1.If there is equity in the home, it may be possible to refinance at a lower than prime rate especially if the credit is strong.

2.It may be possible to defer mortgage payments for a couple of months while something is worked out. It never hurts to talk to the lenders, but you must talk to them AS SOON as you realize there is a problem. Dont put it off.

3.Supplement your income with weekend or evening work while you put the house on the market. Better to downsize than to lose your credit rating.

There are always options that havent been considered yet. There are even private lenders that could be willing to work out a plan. If keeping the house is an absolute must, then look in to options beyond the sell and rent back property industry. In the long run, you will be more satisfied with the results.
